Obtaining a Deed of Indemnity from a developer to protect clients and their lender (who otherwise would not have proceeded with the mortgage) as the developer had not complied with planning obligations more than 8 years after completing the development.
Obtaining confirmation from the Cheshire Brine Subsidence Compensation Board (CBSCB) that they had approved the foundations to a property on a new development so that the client would be able to obtain the benefit of the compensation from the CBSCB in the event that the property suffers subsidence in the future. This was important as there had been a subsidence claim on the land in the 1950’s and so any future development is only covered if the foundations have been approved by the CBSCB.
I got an uneasy feeling about a plot plan on a new development so carried out an additional search at the Land Registry and discovered that part of the land in the plot (part of the rear garden and a rear access to the property), was not owned by the developer. Two further revised plans were needed to resolve the position. If I had not listed to my gut and got the searches before completion we would not have been able to register the clients’ purchase and get them title to all of their property; only the part that was owned by the developer which excluded the rear section of garden and the rear access to the property.
